These terms apply to every booking made with Atlas&Ocean for the Toubkal Summit trek and, once it opens, the Mountain & Ocean trip. Booking a place means you accept them. If anything below is unclear, ask before you pay rather than after — the enquiry form and email both reach me directly.

Who you are contracting with
Atlas&Ocean is a trading name based in Marrakech, Morocco, operating guided treks in the High Atlas and, from 2027, on the Atlantic coast at Essaouira. Enquiries and bookings are handled personally by the founder, Zakaria Basraoui.

What you are buying
The Toubkal Summit trek is a three-day, two-night guided package departing Friday from Marrakech and returning Sunday evening. The price is €350 per person. It includes return transport from and to Marrakech, a certified local mountain guide at a ratio of one guide per four walkers on summit day, two nights’ accommodation (a family gîte in Aremd and a dormitory bed at the Toubkal refuge), all breakfasts and dinners plus two trail lunches, crampons and an ice axe when the season requires them, trekking poles, a refuge sleeping bag, group first aid and oxygen, and all national park fees and permits.
It does not include flights, travel and evacuation insurance, personal clothing and boots, meals outside the itinerary, or tips. There is no single supplement and no service fee. The full price sheet, including optional extras, is on the prices page.
Group size is capped at eight walkers per departure and we do not exceed it. The Mountain & Ocean trip is in development and not yet bookable; joining its waiting list creates no contract and takes no payment.

Booking, deposit and balance
A booking is confirmed when we have acknowledged your place in writing and received the deposit. Until both have happened, no place is held.
- Deposit
- €120 per person, payable on booking. It holds your place and is deducted from the total.
- Balance
- Due no later than 14 days before departure, or on arrival if we have agreed that in writing beforehand.
- How to pay
- Card or bank transfer. Instalments on request — ask and we will set them up.
- Currency
- Prices are quoted and charged in euros. Any conversion cost your bank applies is yours.

Changing your dates
- 45+ days before
- Free, and as often as you need. Subject to space on the departure you move to.
- Inside 45 days
- One change for €40, subject to space. Beyond that the cancellation terms in section 05 apply.

If you cancel
Cancellations take effect on the day we receive them in writing. The ladder is short on purpose, and it is the same one published on the price page.
- 30+ days before
- Full refund, less the €120 deposit.
- 14–30 days before
- Half of what you have paid is refunded.
- Under 14 days
- No refund — but your place is transferable to anyone you name, at no charge, up to the day before departure.

If we change or cancel
We may have to change an itinerary for reasons of safety, weather, road access or the availability of accommodation on the mountain. Where a change is insignificant — a different gîte in the same village, a reordered afternoon — we will tell you and the booking stands.
Where a change significantly alters the package, or where we cancel a departure outright, you may accept the alternative we offer, move to another date at no charge, or take a full refund of everything you have paid, including the deposit. If we cancel because a departure has not reached a viable group size, we will tell you at least 14 days before departure.
We are not able to refund costs you have arranged yourself, such as flights. That is what the insurance in section 09 is for.

Weather, the summit and the guide’s authority
The summit is the aim and it is never the promise. Your guide has the final word on summit morning — not the group, and not us. There is a fixed turnaround time of 09:00 and a visibility floor of 50 metres on the upper ridge, and he will turn a group around without negotiation if either is breached or if conditions warrant it. We regard that authority as the most important thing you are buying.
If the guide turns the group around for weather or safety, the attempt is on us: you get a free date change on any future departure and you pay only for the refuge night on the attempt you made. You can read what that looked like in practice in the dispatch about turning around at 3,900 m.
A turnaround is not a cancellation and does not trigger a refund under section 06. If you choose to leave the trek yourself, no refund is due for the unused part.

Fitness, health and honesty
This is a high-altitude trek to 4,167 metres involving up to nine hours of walking in a day on rough ground. It requires no technical climbing skill. It does require that you are comfortable walking six to eight hours on rough ground on consecutive days.
You must tell us before booking about any medical condition, medication, injury, pregnancy or previous altitude illness that could affect you or the group. We treat that information confidentially and we use it to place you well, not to exclude you. If you withhold something material and it puts you or the group at risk, we may decline to take you on the mountain, and no refund will be due.
If you are unsure whether altitude is safe for you, speak to a doctor or a travel clinic before you book. We are mountain guides and trip organisers, not medical practitioners. What we do about altitude on the trip is described in the altitude briefing.
Minimum age is 16, and anyone under 18 must be accompanied by a parent or guardian on the trek.

Insurance is compulsory
You must hold travel insurance that covers trekking to at least 4,200 metres and helicopter evacuation, and you must be able to show it. We check. Many standard travel policies cap trekking at a stated altitude below that, or exclude it altogether, so read the limit in your own policy wording rather than the marketing page — cover that stops short is not sufficient, and we will not take you on the mountain without cover that holds. Send us the policy summary and we will tell you whether it does.
We strongly recommend that the policy also covers cancellation, so that a change in your own circumstances does not leave you out of pocket under section 05.

What we ask of you on the mountain
- Follow your guide’s instructions on safety, route and pace.
- Bring the personal kit on the list in the practical briefing. We can rent you boots and a jacket, but not at short notice on the Friday.
- Respect the villages the trail passes through: ask before photographing people, and cover shoulders and knees.
- Take your rubbish off the mountain. This is a national park and the refuge is not a bin.
- Behave in a way that does not spoil the trip for the other seven people. We reserve the right to end a person’s participation for behaviour that endangers or seriously disrupts the group, with no refund.

Our liability
We are responsible for delivering the package described in section 02 with reasonable skill and care, and for the acts and omissions of the guides, drivers and accommodation we engage to deliver it. Where something in the package is not delivered as described, tell us at the time so we can put it right; if we cannot, section 13 explains how to complain.
We are not liable for events outside our reasonable control — weather, rockfall, road closures, airline delay, strike, civil unrest, or the closure of the mountain or the refuge by the authorities — nor for loss or injury arising from your own failure to follow the guide’s instructions, from equipment you supplied yourself, or from a medical condition you did not disclose under section 08. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited.
Mountain trekking at altitude carries inherent risk that no operator can remove. We reduce it deliberately — the acclimatisation night, the small group, the guide ratio, the fixed turnaround, the oxygen — and we do not pretend it is absent.

Your money if we fail
Because this is a package holiday and we take payment in advance, the money you pay before you travel is required to be protected against our insolvency under Directive (EU) 2015/2302 on package travel.

If something goes wrong
Tell your guide at the time, on the mountain, while it can still be fixed. If it cannot be fixed there, write to info.atlasandocean@gmail.com within 28 days of returning. I answer these myself and I will reply within seven days. There is no complaints department to be passed between.

Photographs
We sometimes photograph trips and would like to use those pictures on this site. If you would rather not appear, tell your guide at the start and that is the end of it — no explanation needed, and it changes nothing else about your trip. If you have already appeared in something and change your mind, email me and it comes down.

Law, and changes to these terms
These terms are governed by Moroccan law, and nothing in them removes the rights you hold as a consumer under the law of your own country of residence, including your rights under Directive (EU) 2015/2302 if you booked from the European Union.
We may update these terms, and the version that applies to your booking is the one published on the day you booked. The date at the top of this page is when it last changed.
